1. Definitions
"We", "us", "our" means Marsh Environmental of 2 Station Rd, Heswall, Wirral CH60 8PW. "You", "the client" means the individual, executor, agent or business engaging our services. "Services" means the specialist cleaning, decontamination, clearance and disposal work described in our written estimate.
2. Quotations & acceptance
All quotations are issued in writing after a free on-site or remote assessment. A quotation is valid for 30 days from issue unless stated otherwise. Acceptance by email, signed estimate or verbal confirmation followed by a booked date constitutes a binding contract on these terms.
3. Pricing & extras
Quoted prices are fixed for the scope described. If, on arrival, the volume, contamination level or hazard class materially differs from what was described, we will pause work and issue a revised written estimate before continuing. No variation will be charged without your prior agreement.
4. Payment terms
Domestic jobs: payment in full on completion by card or bank transfer. Trade, letting-agent, insurer and local-authority clients: 14-day invoice terms unless otherwise agreed in writing. Late payment carries interest at 8% above the Bank of England base rate under the Late Payment of Commercial Debts (Interest) Act 1998.
5. Access & site readiness
You confirm you are authorised to instruct work at the property and to consent to the disposal of items found within it. You will provide safe access, parking arrangements where required, and disclose any known hazards (asbestos, drugs, weapons, structural risk) before we attend.
6. Items of value & sentimental items
Where requested, we will set aside items of apparent value or sentimental nature for the client/executor to review before disposal. We accept no liability for items not identified to us in advance and disposed of in good faith as part of an agreed clearance.
7. Hazardous waste
All hazardous and clinical waste is removed, tracked and disposed of by licensed facilities under our Environment Agency Waste Carrier registration. A Waste Transfer Note (or Consignment Note for hazardous waste) will be supplied as standard.
8. Cancellation
You may cancel free of charge up to 48 hours before the scheduled start. Cancellations within 48 hours may attract a charge of up to 25% of the quoted value to cover crew scheduling and disposal slot bookings.
9. Liability
We carry Public Liability and full Employer's Liability insurance. Our liability for any single claim is capped at the insured limit and excludes consequential or indirect loss. Nothing in these terms limits liability for death or personal injury caused by negligence or for any liability that cannot lawfully be limited.
10. Photographs & confidentiality
We take before/after photographs solely for completion records and waste-compliance evidence. We will never publish identifiable images of your property without your written consent, and we never disclose client identities to third parties.
11. Complaints
If any element of our work falls below our written sign-off standard, please contact us within 7 days. We will return and re-do affected areas at our cost where the issue is attributable to our work.
12. Governing law
These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
